What if I show up to vote, but I'm not on the list of registered voters?


By law, if a voter arrives to vote but the voter's name  does not appear on the list of registered voters due to a clerical error, the law allows for provisional voting. If your name is not on the rolls of registered voters in your county, but you believe you are registered, the election judge will attempt to determine if you are registered somewhere in your county. (The Federal Help America Vote Act (HAVA) of 2002)

If your registration cannot be found or you did not bring an acceptable form of ID, you may cast a provisional vote by filling out an affidavit and a paper ballot. This ballot is kept separate from the regular ballots, and the case will be reviewed by the provisional voting ballot board. The ballot will be counted only if the voter is determined to be a registered voter in that county. Provisional voters will receive a notice in the mail by the tenth day after the local canvass advising them if their provisional ballots were counted and, if they were not counted, the reason why.

If you vote provisionally, you will need to visit the Hays County Elections Administrator's office within six (6) calendar days of the date of the election to present one of the seven (7) acceptable forms of photo ID in order for your provisional ballot to be counted. (The exception is a provisional vote cast instead of a mail-in ballot. The State of Texas provides certain other options for those who qualify if you are not able to present one of the seven acceptable forms of ID, including the execution of a Reasonable Impediment Declaration and presenting one of the acceptable forms of supporting ID.

Voting early gives you time to solve any issues you may encounter when voting.

Protections

  • Texas Election Code protects voters' right to cast their vote in secret and free from intimidation, including direct confrontation of voters, insulting, offensive, or threatening language, spreading false information about voter requirements, blocking entry to a polling place, attempting to act as a poll watcher without certification, or use or threat of physical force.
  • If you are registered to vote but your name does not appear in the list of registered voters, Texas Election Code protects your right to cast a provisional ballot.
  • The possession of guns and other weapons are prohibited in a polling place, except for those carried by peace officers

The Texas Civil Rights Project is one of several nonprofits that the League of Women Voters of Texas works closely with to protect voters' rights. In coordination with the League of Women Voters of Hays County, they played a key role in convincing the Hays County Commissioner's Court to open additional polling locations and extend the number of days and hours of voting at Texas State University during the 2018 midterm elections.
